General
These terms and conditions apply to all transactions with Van Galen Logistiek BV. By booking a shipment by the customer, customer declares unconditional agreement to these terms and conditions. The Service Provider reserves the right to unilaterally amend these Terms and Conditions or the Service without prior notice. The Service Provider shall only be bound by the version of the updated General Terms and Conditions posted at www.van-galen.nl.
The applicability of general terms and conditions other than these, of the Customer or otherwise, is expressly rejected.
Products and service, Service in the Benelux
In the Netherlands and a large part of Belgium, we deliver your shipments within 24/48 hours on weekdays. On the Wadden Islands and in the Grand Duchy of Luxembourg within 48 hours. Due to special circumstances such as store closure, no one at home, wrong address and sorting errors, it may exceptionally happen that your shipment does not arrive within this time. If the address provided is incorrect or incomplete in the order, a surcharge of € 4.95 per order will be charged for figuring out the correct delivery address.
Not at home? Second delivery.
If the addressee is not at home we will offer the shipment again the next day. The costs for this 2nd delivery will be charged.
A private addressee will receive a card in the mail asking him to contact us to make a new delivery appointment within 5 days. If there is no response within that period, we will return the shipment on the 6th day.
Refusal
If your customer refuses a shipment, we will ask you to agree on a new delivery date. The shipment will then be delivered a second time or returned within 3 days. You will be charged for the cost of the second delivery.
Signature
We treat every shipment as a registered document. Your relations sign for proper receipt on a delivery list or on the display of a portable minicomputer. This way there is never any uncertainty about the arrival of your shipments. You can request the proof of receipt with signature from the logistics department. Collection orders and redelivery
Return shipments (From almost any location within the Benelux (excluding Wadden Islands) we can pick up and deliver to you or – in the Netherlands only – to a third address. For an order on day A, collection on day B and delivery on day C at your address, the delivery rate applies with a surcharge of 50%. For a Forwarding to a third address applies a surcharge of 100%. As the client, you will receive an invoice for this. Collection orders and Redeliveries where we load in vain will be charged. If the shipment is insufficiently packed for transport, the driver may leave the shipment.
Wadden Islands
We deliver your shipments the next day to the shipping companies that operate the ferry services and also provide delivery. This is subject to a 100% surcharge on the NL delivery rate. The lead time of your shipment is therefore 2 to 3 days. Because we do not deliver your shipments ourselves, a +Plus service is not possible. Also, you will not find current delivery details on our track & trace.
Packaging
We work with the technical tools common in our industry. Therefore, the packaging of your shipments must be of transport quality so that the contents are adequately protected. Sturdy packaging, properly closed and padded, prevents sagging and shifting. The packaging should be such that the shipment is not lost or damaged in transit or cause damage (including injury) because of the packaging. Packaging should further be such that the shipment can withstand the wear and tear that occurs during road transport.
Shipping units
The rate is divided by various shipping units such as general cargo, long cargo and various pallet shapes. The variety of shipping units allows you to better control your transportation costs. Additional services, Saturday deliveries and ‘Plus deliveries’ are subject to surcharges. You may find these on your rate sheet.
Mono-Collo
The package+ rate applies to shipments of one package to one delivery address in the Netherlands with a maximum weight of 30 kg. and maximum 0.3m3. If one of the dimensions is exceeded, the general cargo criteria apply.
Piece goods
The general cargo rate applies to shipments of one or more packages to one delivery address. The maximum weight per package is 30 kg. Above that, a pallet must be used, for which the pallet rate applies. The maximum number of packages per shipment is 10 pieces. Above that, a surcharge applies. If you want to send a larger number to one address, you can offer them on a pallet. Packages longer than 200 cm will be treated as length goods.
Spring Goods
Packages with at least one side between 200 and 600 cm in length, are counted as length goods. Examples are bundles, tubes, tubes and ladders. The significantly higher processing time justifies that these piece goods are charged at extra cost.
Volume weight calculation
The tariff rates apply to the total actual weight of the shipment unless the calculated volume weight is higher.
The standard basis for calculating volume weight is 250 kg/m3. For the freight rate calculation, the highest value in the comparison of the actual weight of the shipment with the product of the volume in m3 and 250 kg/m3 always applies. Example: a shipment consists of 4 packages, each measuring 80 x 40 x 25 cm, with a total weight of 40 kg. The volume weight of this shipment is 80 x 40 x 25 cm = 0.080 m³ x 4 packages = 0.320 m³ x 250 kg/m³ = 80 kg. The shipment is freighted as 80 kg and not 40 kg.
Pallet shipments
Pallet shipments include all goods stacked on a load board for movement by pallet truck or forklift. Foil or straps hold the packages together so that no package is loose. We know europallets’, ‘block pallets’ and ‘special pallets’, of which both the dimensions and the maximum allowable weight vary from pallet to pallet.
A surcharge may apply for the exchange of europallets at your consignee. When exchanging pallets, the shipper is responsible for having the pallets ready at the delivery address. Return of exchanged europallets can also be charged. The average lifespan of a euro pallet is approx. 7-13 shipments. For this reason, we apply an exchange correction factor of 10% on the number of europallets shipped.
When using pallets, the load must not protrude. For goods that protrude beyond the ground surface of the pallet, we charge the rate on the basis of load meters (NL) or the number of whole pallet spaces the pallet occupies.
If pallets are heavier than allowed according to the rate sheet, we charge for the next pallet size with a higher maximum allowed weight. If that maximum is reached then a surcharge of 100% of the rate applies.
Waiting times
If pickup or delivery of you shipment exceeds the standard waiting times, we reserve the right to charge waiting time fees. From 1 to 5 pallets we take 15 minutes unloading time as standard, for half a trailer 30 minutes and for a full trailer 1 hour unloading time. If this is exceeded v

Plus services, Time deliveries: urgent and after noon
When additional activities are carried out when picking up or delivering your goods, this is called “Plus delivery”. For the possibilities which Plus Services we offer please refer to the form ‘Products and Service’ the rates can be found on the rate sheet ‘Plus Services’.

- Class 1 (except 1.4 S) Explosive substances and articles
- Class 4.2 & 4.3 Substances liable to spontaneous combustion with the exception of aerosols.
- Class 5.1 & 5.2 Oxidizing substances and organic peroxides
- Class 6.2 Infectious substances
- Class 7 (except sheets 1 to 4) Radioactive material
- Class 9.1, 9.2b, 9.3, 9.13b Miscellaneous dangerous substances and articles.

General conditions
The 2002 General Transport Conditions (AVC) apply to agreements concerning road transport in which we act as ‘carrier’. Cross-border road transport takes place in accordance with the CMR Convention and in addition to the aforementioned AVC. All disputes arising from or related to (the) agreement(s) concluded between the parties shall be settled by the competent court in Rotterdam. Dutch law shall apply. The conditions can be sent free of charge upon request.
All our activities and agreements are subject to the PDG/TLN Psysical Distribution conditions, filed with the Registries of the District Courts in Amsterdam and Rotterdam, latest version. A copy of these terms and conditions will be sent to the client upon request.
The General Terms and Conditions for Electronic Message Traffic (AVEB) apply to the electronic exchange of messages between computers (EDI), filed with the Registry of the District Court in The Hague, most recent version.
Liability
Please note that van Galen Logistiek BV has only limited liability in case of damage and/or loss. Therefore, we advise you to assess, based on the value of your goods, whether taking out an insurance is desirable. If the goods have been signed for good receipt, we will decline any liability. All claims are time-barred after 12 months from the date of shipment.
Following on from the above, we also draw your attention to the fact that goods in storage and logistics centers of Van Galen Logistiek are not insured and therefore advise you to take out your own insurance. The owner of the goods must also submit a statement from his own insurer stating that the right of recourse shall never be exercised against van Galen Logistiek, expressly stated by van Galen Logistiek that no claim shall be transferable to third parties.
Jewellery, securities, coupons, specimens, documents, radio-active substances, antiques, collectors’ items with enthusiast value, computer software, fragile goods made of glass, crystal, porcelain or ceramics always fall outside our liability in accordance with the above two conditions.
Based on the value of the goods to be insured, we advise you to assess whether the conclusion of goods transport insurance through your insurance company is desirable. In case of loss or damage, we will act in accordance with the applicable terms and conditions, whereby the acceptance of our liability may also serve as a basis for additional compensation from your insurance company.
Rates and payment terms
Annual rate adjustment
Annually the rates are adjusted to the estimated cost developments as published by the NEA according to the Panteia research submarket fine-meshed distribution which is published in October each year. If the actual cost developments deviate significantly from the estimates, we reserve the right to adjust the percentage.

Fuel surcharge
Continuous, sharp price fluctuations force us to levy a diesel surcharge on the freight costs. As a rule, the surcharge depends on the current pump quotation as listed on the TLN fuel monitor website. The index basis is € 0.82000 excluding VAT. If the diesel price deviates from the index, the surcharge goes up by 1% per € 0.034. The average price for a month determines the surcharge for the following month.
Billing and payment
You will receive an itemized invoice from us on a weekly/monthly basis. For invoice amounts lower than €75,= we charge €12,50 administration costs. The payment term is 14 days after the invoice date.
The General Terms of Payment, drawn up by Transport en Logistiek Nederland for the Dutch transport sector, apply in full. These conditions have been filed at the Office of the District Court in The Hague on July 2, 2002, deed number 69/2002.
